Contest Rules

  1. How to Enter

    No purchase necessary to enter. The Xplore Orange Shirt Day Photo contest (the “Contest”) starts on Thursday, September 29, 2022 at 9:00 AM EST and ends on Friday, October 7th, 2022 at 4:00 PM EST (the “Contest Period”). To enter the Contest: (i) visit xplornet.com/enter-to-win-photo-contest to fully complete and submit the contest entry form then (ii) email one or more photos to [email protected] (the “Photo” ) illustrating how you commemorated the National Day for Truth and Reconciliation along with a caption describing the photo including “Xplore Orange Shirt Day Photo Contest” in the subject line and your full name in the body of the email. Photos submitted by email without a contest entry form will be disqualified. Your Photo must comply with the Photo Submission Guidelines provided in paragraph 6 below. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means including use of any automated system to participate, or do not conform to or satisfy any condition of these Contest rules and regulations (“Rules”) may be disqualified. All entry forms submitted become the property of the Sponsor and will not be returned.

  2. Eligibility

    The Contest is open to legal residents of Canada, who have reached the age of majority in the jurisdiction in which they reside at the time of entry and are employees or dealers (and their employees) of Xplore Inc. (the “Sponsor”).

  3. Prizes

    There is one prize (“Prize”) available to be won consisting of a framed copy of Star Child, a print by Algonquin artist Chantal Lanouette. Approximate retail value of the Prize $50 CAD. The Sponsor reserves the right to substitute the Prize for a prize of equal or greater value in the event the Prize is unavailable for any reason. The Prize must be accepted as awarded and no substitutions, except as identified above, will be made. The Prize may not be sold, transferred or assigned and is not convertible to cash.

  4. Prize Draw

    On October 7, 2022 at approximately 4:30 PM EST a random draw for the Prize will take place from among all eligible entries received during the Contest Period. The first entry drawn will be eligible to win the Prize. The odds of winning depend on the number of eligible entries received during the Contest Period. The Sponsor will attempt to contact the potential winner by email within 5 business days after the draw. In the event the potential winner cannot be contacted within 5 business days after the draw, he/she will be disqualified and an alternate potential winner may be drawn at the Sponsor’s sole discretion.

  5. Awarding of Prizes

    Proof of identity must be provided upon request. In order to be declared the winner, the potential winner must correctly answer, unaided, a time-limited mathematical skill-testing question administered by the Sponsor and be verified as complying with these Rules. Before being awarded the Prize, the potential winner will be required to sign and return, within the time stipulated by the Sponsor, a contest eligibility and liability/publicity release confirming compliance with these Rules and releasing the Sponsor and its directors, officers, agents, representatives, successors and assigns from all liability and, except where prohibited by law, permitting the Sponsor to publish, reproduce and/or use in any and all forms of media each potential winner’s name, address (city and province), voice, photograph or other likeness, and/or his/her Photo, without further notice or compensation, worldwide and in perpetuity, in any publicity carried out by the Sponsor.

  6. Submission Guidelines

    • Photos must be original work and must not include any third party’s proprietary content, including trademarks or copyrighted content. The Sponsor in its sole and absolute discretion may disqualify any entrant who uses third party proprietary content at any time and/or edit any Photo blur out any trademarks or to remove any copyrighted content;
    • Photos must not contain any reference to, or likeness of, any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence.
    • Photos must not include any illegal, defamatory or in any way obscene or other objectionable or inappropriate content, as determined by the Sponsor in its sole discretion. Photos cannot be a parody or derogatory.

    By entering the Contest and submitting a Photo, each entrant: (i) represents and warrants that his/her Photo is his/her original work and does not infringe on any third party’s copyright, trade-mark or other intellectual property rights; (ii) represents and warrants that he/she has all necessary rights from any third party that appears, or is mentioned, in the Photo, including those from the parent or legal guardian if third party is under the age of majority; (iii) grants the Sponsor an unlimited, royalty free, irrevocable, right and license to publish, reproduce and/or use his/her Photo in any and all forms of media, including, without limitation, on the Sponsor’s social networking pages, without notice or compensation; (iv) waives all moral rights in the Photo in favour of the Sponsor; and (v) agrees to release and hold harmless the Sponsor and its directors, officers agents, representatives, successors and assigns from any claim or liability arising from or related to the Photo and/or his/her participation in this Contest. The Sponsor assumes no responsibility for any claims with respect to the Photos.

  7. General

    By entering the Contest, entrants agree to abide by these Rules and further agree that the decisions of the Sponsor are final. The Sponsor reserves the right, subject to the approval of the Régie des Alcools, des courses et des jeux du Québec, at any time without prior notice to suspend, modify or terminate the Contest for any reason. The Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering or disrupting the online entry process or the operation of the Contest or acting in violation of these Rules. The Sponsor does not assume any responsibility for any lost, delayed, incorrect or incomplete entry information howsoever caused. The Sponsor is not liable for injuries, death, damages or losses of any kind resulting from participation in the Contest or acceptance or use of the Prize. In the event of a dispute, entries submitted online will be deemed to have been made by the authorized account holder of the email address submitted at time of entry. “Authorized account holder” means the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

  8. Privacy and Personal Information

    By entering this Contest each entrant consents to the collection, use and disclosure of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling the Contest. Any personal information will be handled in accordance with the privacy policy of the Sponsor, which is located at https://www.xplore.ca/policies.... Any inquiry concerning the personal information held by the Sponsor should be addressed to the Sponsor at 625 Cochrane Drive, Suite 1000, Markham, Ontario, L3R 9R9.

  9. Publicity of Winners List

    The name of the Prize winner may be posted online or otherwise beginning on the first business day after the winner has been contacted and has returned a fully completed contest eligibility and liability/publicity release to the Sponsor as set out above.

  10. Subject to Applicable Laws

    This Contest is governed by the laws of Canada, is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited. For Québec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des Alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
