The Xplornet Photo and Video contest (the “Contest”) starts on Thursday, June 2, 2022 at 4:00 PM EST and ends on Friday, July 8, 2022 at 4:00 PM EST (the “Contest Period”). To enter the Contest: (i) visit xplornet.com/spring-photo-and-video-contest to fully complete and submit the contest entry form then (ii) email one or more photos and videos (each a “Submission” and collectively, “Submissions”) to [email protected] taken while on the job, or out in your community, illustrating small town/rural/remote Canadian life, or that demonstrate how rural Canadians use Xplornet Internet, along with a detailed explanation of the Submission. Your email must also include “Xplornet Photo and Video Contest” in the subject line and your full name in the body of the email. You will receive one entry into the Contest for each Submission you enter. If you’re an Xplornet field technician, we encourage you to enter Submissions of speed tests you have taken after installing or improving a customer’s service. You may not enter the same Submission more than once. Submissions entered by email without a contest entry form will be disqualified. Submissions must comply with the Submission Guidelines provided below. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means including use of any automated system to participate or do not conform to or satisfy any condition of these Contest rules and regulations (“Rules”) may be disqualified. All entry forms submitted become the property of the Sponsor and will not be returned.
The Contest is open to legal residents of Canada, who have reached the age of majority in the jurisdiction in which they reside at the time of entry and are employees or dealers (and their employees) of Xplore Mobile Inc. or Xplornet Communications Inc. (the “Sponsor”).
There are five grand prizes (“Prizes”) available to be won, each consisting of a $100 prepaid gift card. The Sponsor reserves the right to substitute any Prize in whole or in part for a prize of equal or greater value in the event that any component of a Prize is unavailable for any reason. The Prizes must be accepted as awarded and no substitutions, except as identified above, will be made. The Prizes may not be sold, transferred or assigned and are not convertible to cash.
On July 8, 2022 at approximately 4:30 PM EST a random draw for the Prizes will take place from among all eligible entries received during the Contest Period. The first 5 entries drawn will be eligible to win a Prize. The odds of winning depend on the number of eligible entries received during the Contest Period. The Sponsor will attempt to contact the potential winners by email within 5 business days after the draw. In the event a potential winner cannot be contacted within 5 business days after the draw, he or she will be disqualified and an alternate potential winner may be drawn at the Sponsor’s sole discretion.
In order to be declared a winner, each potential winner must correctly answer, unaided, a time-limited mathematical skill-testing question administered by the Sponsor and be verified as complying with these Rules. Proof of identity must be provided upon request. Before being awarded a Prize, each potential winner will be required to sign and return, within the time stipulated by the Sponsor, a contest eligibility and liability/publicity release confirming compliance with these Rules and releasing the Sponsor and its directors, officers, agents, representatives, successors and assigns from all liability and, except where prohibited by law, permitting the Sponsor to publish, reproduce and/or use in any and all forms of media each potential winner’s name, address (city and province), voice, photograph or other likeness, and/or his/her Submission, without further notice or compensation, worldwide and in perpetuity, in any publicity carried out by the Sponsor.
Submissions remain the property of the entrant, however by entering the Contest, each entrant: (i) represents and warrants that his/her Submission is his/her original work and does not infringe on any third party’s copyright, trade-mark or other intellectual property rights; (ii) represents and warrants that he/she has all necessary rights from any third party that appears, or is mentioned, in the Submission, including those from the parent or legal guardian if third party is under the age of majority; (iii) grants the Sponsor an unlimited, royalty free, irrevocable, right and license to publish, reproduce and/or use his/her Submission in any and all forms of media, including, without limitation, on the Sponsor’s social networking pages, without notice or compensation; (iv) waives all moral rights in the Submission in favour of the Sponsor; and (v) agrees to release and hold harmless the Sponsor and its directors, officers agents, representatives, successors and assigns from any claim or liability arising from or related to the Submission and/or his/her participation in this Contest. Submissions may be showcased by the Sponsor at its sole and absolute discretion on a public viewing gallery. The Sponsor assumes no responsibility for any claims with respect to any Submission.
By entering the Contest, entrants agree to abide by these Rules and further agree that the decisions of the Sponsor are final. The Sponsor reserves the right, subject to the approval of the Régie des Alcools, des courses et des jeux du Québec, at any time without prior notice to suspend, modify or terminate the Contest for any reason. The Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering or disrupting the online entry process or the operation of the Contest or acting in violation of these Rules. The Sponsor does not assume any responsibility for any lost, delayed, incorrect or incomplete entry information howsoever caused. The Sponsor is not liable for injuries, death, damages or losses of any kind resulting from participation in the Contest or acceptance or use of the Prize. In the event of a dispute, entries submitted online will be deemed to have been made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” means the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.
By entering the Contest each entrant consents to the collection, use and disclosure of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling the Contest. Any personal information will be handled in accordance with the privacy policy of the Sponsor which is located at http://www.xplornet.com/legal/xplornet-privacy-policy/). Any inquiry concerning the personal information held by the Sponsor should be addressed to Xplornet Communications Inc. at 625 Cochrane Drive, Suite 1000, Markham, ON L3R 9R9.
The name of the Prize winners may be posted online or otherwise beginning on the first business day after the winners have been contacted and have returned a fully completed contest eligibility and liability/publicity release to the Sponsor as set out above.
This Contest is governed by the laws of Canada, is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited. For Québec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des Alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
