Contest Rules

  1. Contest Period

    The NPS contest (the "Contest") commences at 1 AM EST on April 1, 2024, and closes at 1 AM EST on April 30, 2024 (the "Contest Period").

  2. How to Enter

    No purchase necessary. To enter the Contest, within 72 hours of receipt of a "welcome" or "technician install" email from Xplore Inc., you must complete and submit (1) the survey ("Survey") using the link provided in the email and (2) the contest entry form during the Contest Period. You will then obtain one entry into the Contest. Limit of one entry per person during the Contest Period. Survey responses and Contest entries shall be deemed to be submitted by the authorized account holder of the email address to which the Survey was originally sent. "Authorized account holder" is defined as the natural person who is assigned to an email address by an internet access provider, online service provider or other organization (e.g. business, educational, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

  3. Eligibility

    To be eligible to enter the Contest, eligible participants must be: the authorized holder of the email account to which Xplore Inc. sent the "welcome" or "technician install" email containing the Survey; a legal resident of Canada; and over the age of majority in such eligible participant's province or territory of residence. Employees, officers, and directors (including immediate family members and members of the same household) of Xplore Inc. (the "Sponsor") and its affiliates, distributors, dealers, marketing representatives, printers, advertising or promotional agencies, or any other organization associated with the Contest are not eligible to participate.

  4. Prize

    One grand prize (the "Prize") is to be awarded consisting of a Samsung Galaxy Tab A SM-T290 (2019) 8" Tablet - Black (Approx. retail value $179.99 CAD). The Sponsor reserves the right to substitute any Prize in whole or in part for a prize of equal or greater value in the event that any component of a Prize is unavailable for any reason. The Prize must be accepted as awarded and no substitutions, except as identified above, will be made. The Prize may not be sold, transferred or assigned and is not convertible to cash.

  5. The Draw

    The winner of the Contest will be selected in a random draw conducted by Xplore Inc. of all eligible entries received during the Contest Period. The random drawing will take place at 10 AM on April 30, 2024. The first entry drawn will be eligible to win the Prize. The odds of winning will depend on the number of eligible entries received during the Contest Period. The Sponsor will attempt to notify the selected entrant by email within 7 days of the draw. In order to be declared a winner, the selected entrant must unaided correctly answer a time-limited skill-testing question and, within 10 days, complete and return to the Sponsor a contest eligibility and liability/publicity release confirming among other things, compliance with these rules and regulations ("Rules"), releasing the Sponsor and its directors, officers, shareholders and agents from all liability and, except where prohibited by law, permitting the Sponsor to use the selected entrant's name, address (city and province) and image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsor. Selected entrant must also provide proof of identity (photocopy of Driver's License, Passport or any other government-issued photo identification). In the event that a selected entrant is not eligible for any reason, has not correctly answered the skill-testing question or cannot be contacted after 7 business days of the first attempt to contact the selected entrant, such entrant shall be disqualified and the Sponsor shall have the right to select another entrant and the Sponsor shall be released and discharged from any liability or responsibility in this regard. No correspondence will be made except with the selected entrant.

  6. General

    By entering the Contest, entrants agree to abide by these Rules and further agree that the decisions of the Sponsor are final. The Sponsor reserves the right, subject to the approval of the Régie des Alcools, des courses et des jeux du Québec, at any time without prior notice to suspend, modify or terminate the Contest for any reason. The Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering or disrupting the online entry process or the operation of the Contest or acting in violation of these Rules. The Sponsor does not assume any responsibility for any lost, delayed, incorrect or incomplete entry information howsoever caused. The Sponsor is not liable for injuries, death, damages or losses of any kind resulting from participation in the Contest or acceptance or use of the Prize. In the event of any discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, as applicable, the English version shall prevail, govern and control.

  7. Privacy and Personal Information

    By entering the Contest each entrant consents to the collection, use and disclosure of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling the Contest. Any personal information will be handled in accordance with the privacy policy of the Sponsor which is located at https://www.xplore.ca/policies/privacy-policy/). Any inquiry concerning the personal information held by the Sponsors should be addressed to the Sponsor at 625 Cochrane Drive, Suite 1000, Markham, Ontario, L3R 9R9.

  8. Publicity of Winner’s Name

    The name of the Prize winner may be posted online or otherwise beginning on the first business day after the winner has been contacted and has returned a fully completed contest eligibility and liability/publicity release to the Sponsor as set out above. By entering the Contest, each entrant consents to the use of his or her name and image without compensation, in any publicity worldwide that is carried out in any media by or on behalf of the Sponsor.

  9. Subject to Applicable Laws

    This Contest is governed by the laws of Canada, is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited. For Quebec residents, any litigation respecting the conduct or organization of this Contest may be submitted to the Regie des alcools, des courses et des jeux du Quebec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
