"My Story” Contest OFFICIAL RULES AND REGULATIONS

How to Enter.

No purchase is necessary to enter. To enter the "My Story” contest (the “Contest”), followers of @Xplore.ca on Facebook, @Xplore_ca Twitter and @Xplore__ca on Instagram must post a story about how they use Xplore Internet (the “Submission”) during the contest period commencing at 4 PM EST on January 6, 2025, and ending at 4 PM EST on January 12, 2025 (the “Contest Period”). On Facebook and Twitter, Submissions can be posted either in the comments of Xplore’s post about the Contest, or in a separate post. If posted as a separate post, Xplore must be tagged in the post. On Instagram, Xplore must also be tagged in the post. Your Submission must comply with the Submission Guidelines provided below. If your Submission is received during the Contest Period in accordance with these official rules and regulations (the “Rules”), as determined by the Sponsor in its sole discretion, you will be eligible to receive one entry into the Contest. Limit of one entry per person during the Contest Period.

Submission Guidelines

1. Submissions must be original work and not include any third party proprietary content, including trademarks or copyrighted content. The Sponsor in its sole and absolute discretion may disqualify any entrant who uses third party proprietary content at any time and/or edit any Submission to blur out any trademarks or remove any copyrighted content.
2. Submissions must not contain any reference to, or likeness of, any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence.
3. Submissions must not include any illegal, defamatory or in any way obscene or other objectionable or inappropriate content, as determined by the Sponsor in its sole discretion. Submissions cannot be a parody or derogatory.

By entering the Contest, each entrant: (i) represents and warrants that his/her Submission is his/her original work and does not infringe on any third party copyright, trademark or other intellectual property rights; (ii) represents and warrants that he/she has all necessary rights from any third party that appears, or is mentioned, in the Submission, including those from the parent or legal guardian if third party is under the age of majority; (iii) grants the Sponsor an unlimited, royalty free, irrevocable, right and license to publish, reproduce and/or use his/her Submission in any and all forms of media, including, without limitation, on the Sponsor’s social networking pages, without notice or compensation; (iv) waives all moral rights in the Submission in favour of the Sponsor; and (v) agrees to release and hold harmless the Sponsor and its directors, officers agents, representatives, successors and assigns from any claim or liability arising from or related to the Submission and/or his/her participation in this Contest. The Sponsor assumes no responsibility for any claims with respect to the Submissions .

Eligibility.

The Contest is open to legal residents of Canada who have reached the age of majority in their province or territory of residence as of the date of entering the Contest. Employees, officers, and directors (including immediate family members and members of the same household) of Xplore Inc. (the “Sponsor”) and its affiliates, distributors, dealers, marketing representatives, printers, advertising or promotional agencies, or any other organization associated with the Contest are not eligible to participate.

Prize.

There is one prize (“Prize”) available to be won consisting of a Samsung Galaxy Tab A9+64 GB Graphite (Approx. retail value $329 CAD). The Sponsor reserves the right to substitute the Prize for a prize of equal or greater value in the event that the Prize is unavailable for any reason. The Prize must be accepted as awarded and no substitutions, except as identified above, will be made. The Prize may not be sold, transferred or assigned and is not convertible to cash. The Prize will be shipped to the winner’s address or an alternative location arranged by the Sponsor with the winner. The Sponsor is not responsible for any defects or issues with the Prize.

The Draw.

The winner of the Contest will be selected in a random draw conducted by Xplore Inc. of all eligible entries received during the Contest Period. The random drawing will take place at 9 AM PM EST on January 13, 2025. The Sponsor will attempt to notify the selected entrant using the social media platform which the entrant used to enter the Contest within 7 days of the draw. In order to be declared a winner, the selected entrant must unaided correctly answer a time-limited skill-testing question and, within 10 days, complete and return to the Sponsor a contest eligibility and liability/publicity release confirming among other things, compliance with these Rules, releasing the Sponsor and its directors, officers, shareholders and agents from all liability and, except where prohibited by law, permitting the Sponsor to use the selected entrant’s name, address (city and province), image and Submission, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsor. Selected entrant must also provide proof of identity (photocopy of Driver’s License, Passport or any other government-issued photo identification). In the event that a selected entrant is not eligible for any reason, has not correctly answered the skill-testing question or cannot be contacted after 7 business days of the first attempt to contact the selected entrant, such entrant shall be disqualified and the Sponsor shall have the right to select another entrant and the Sponsor shall be released and discharged from any liability or responsibility in this regard. No correspondence will be made except with the selected entrant.

General.

By entering the Contest, entrants agree to abide by these Rules and further agree that the decisions of the Sponsor are final. Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise illicit means to enter the Contest, or any other methods not authorized by these Rules shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. The Sponsor reserves the right at any time without prior notice to suspend, modify or terminate the Contest for any reason. The Sponsor reserves the right to disqualify any individual they find to be tampering or disrupting the online entry process operation of the Contest or acting in violation of these Rules. The Sponsor does not assume any responsibility for any lost, delayed, incorrect or incomplete entry information howsoever caused. In the event of a dispute, entries will be deemed to have been made by the authorized account holder of the platform account used to submit the entry. "Authorized account holder" means the natural person to whom is assigned the platform account. You agree to the privacy policies and terms of use of the platform and are responsible for ensuring that you comply with them at all times while participating in the Contest. This Contest is in no way sponsored, endorsed, administered by, or associated with Meta or Twitter. By participating in this Contest, you agree to a complete release of Meta and Twitter from any claims. In the event of any discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, as applicable, the English version shall prevail, govern and control.

Privacy and Personal Information.

By entering the Contest each entrant consents to the collection, use and disclosure of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling the Contest. Any personal information will be handled in accordance with the privacy policy of the Sponsor which is located at https://www.xplore.ca/policies/privacy-policy/. Any inquiry concerning the personal information held by the Sponsor should be addressed to the Sponsor at 625 Cochrane Drive, #1000, Markham, ON L3R 9R9.

Publicity of Winner’s Name.

The name of the Prize winner may be posted online or otherwise beginning on the first business day after the winner has been contacted and has returned a fully completed contest eligibility and liability/publicity release to the Sponsor as set out above.

Subject to Applicable Laws.

This Contest is governed by the laws of Canada, is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
