Contest Rules

  1. How to Enter

    No purchase is necessary to enter. To enter the Fall Photo contest (the “Contest”), followers of @Xplore.ca on Facebook, @Xplore_ca Twitter and @Xplore__ca on Instagram must post a Fall-themed photo (the “Submission”) during the contest period commencing at 4 PM EST on Thursday, October 20, 2022 and ending at 4 PM EST on Sunday, October 30, 2022 (the “Contest Period”). On Facebook and Twitter, Submissions can be posted either in the comments of Xplore’s post about the Contest, or in a separate post. If posted as a separate post, Xplore must be tagged in the post. On Instagram, Xplore must also be tagged in any post.

    Your Submission must comply with the Submission Requirements provided in paragraph 5 below. If your Submission is received during the Contest Period in accordance with these official rules and regulations (the “Rules”), as determined by the Sponsor in its sole discretion, you will be eligible to receive one (1) entry (the “Entry”) into the Contest. Limit of one Entry per person during the Contest Period.

    IMPORTANT NOTE: The Contest Sponsor reserves the right at any time, in its sole and absolute discretion, to require proof, in form and substance satisfactory to the Contest Sponsor within the timeframe specified by the Contest Sponsor that: (i) confirms the entrant and the Submission meets all of the applicable requirements specified in these Rules; (ii) the entrant has all necessary permissions and authorizations as required pursuant to these Rules including permission from all persons (or from a parent or legal guardian if such person is a minor) appearing in the Submission; and/or (iii) is required for any other reason that the Contest Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules, or for any other reason. Failure to provide such proof to the complete satisfaction of the Contest Sponsor within the timeline specified may result in disqualification in the sole and absolute discretion of the Contest Sponsor. The Contest Sponsor may reproduce and/or post any Submission submitted as set forth in these Rules in any and all forms of media including its social networking pages and in a blog post as a public viewing gallery. Any Submission that the Contest Sponsor deems, at any time, violates the terms and conditions set forth in these Rules, as determined by the Contest Sponsor in its sole and absolute discretion, may be taken down.

  2. Eligibility

    The Contest is open to legal residents of Canada who have reached the age of majority according to the law of the province or territory in which they reside at the time of entry. Employees, officers, and directors (including immediate family members and members of the same household) of Xplore Inc. (the “Sponsor”) and its affiliates, distributors, dealers, marketing representatives, printers, advertising or promotional agencies, or any other organization associated with the Contest are not eligible to participate.

  3. Prize

    One grand prize (the “Prize”) is to be awarded consisting of a Samsung Galaxy Tab A SM-T290 (2019) 8” Tablet - Black (Approx. retail value $179.99 CAD). The Sponsor reserves the right to substitute any Prize in whole or in part for a prize of equal or greater value in the event that any component of a Prize is unavailable for any reason. The Prize must be accepted as awarded and no substitutions, except as identified above, will be made. The Prize may not be sold, transferred or assigned and is not convertible to cash.

  4. The Draw

    The winner of the Contest will be selected in a random draw conducted by the Sponsor of all eligible entries received during the Contest Period. The random drawing will take place at 4:30 PM EST on Sunday, October 30, 2022. The Sponsor will attempt to notify the selected entrant using the social media platform which the entrant used to enter the Contest within 7 days of the draw. In order to be declared a winner, the selected entrant must unaided correctly answer a time-limited skill-testing question and, within 10 days, complete and return to the Sponsor a contest eligibility and liability/publicity release confirming among other things, compliance with these Rules, releasing the Sponsor and its directors, officers, shareholders and agents from all liability and, except where prohibited by law, permitting the Sponsor to use the selected entrant’s name, address (city and province), image and Submission, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsor. Selected entrant must also provide proof of identity upon request. In the event that a selected entrant is not eligible for any reason, has not correctly answered the skill-testing question or cannot be contacted after 7 business days of the first attempt to contact the selected entrant, such entrant shall be disqualified and the Sponsor shall have the right to select another entrant and the Sponsor shall be released and discharged from any liability or responsibility in this regard. No correspondence will be made except with the selected entrant.

  5. Submission Requirements

    The Submission must be an original Fall-themed photo. The Submission must not include any third party’s proprietary content, including trademarks or copyrighted content. Contest Sponsor, in its sole discretion, may disqualify any entrant who uses third party proprietary content, at any time and/or may edit any Submission to blur out any trademarks or to remove any copyrighted content. Any Submission that involves a third party that does not choose to be part of the Submission may also be disqualified. Submissions must not include any illegal, defamatory or in any way obscene content. Submissions cannot be a parody or derogatory. Submissions remain the property of the entrant, however by entering this Contest, each entrant (i) represents and warrants that his/her Submission is his or her original work and does not infringe on any third party’s copyright, trademark or other intellectual property rights, (ii) represents and warrants that he/she has all necessary rights from any third party that appears, or is mentioned, in the Submission, including those from the parent or legal guardian if third party is under the age of majority; (iii) grants the Contest Sponsor, an unlimited, royalty free, irrevocable, right and license to reproduce and/or post the Submission in any and all forms of media now known or hereafter devised including, without limitation, on the Sponsor’s websites and social networking pages; (iv) waives all moral rights in the Submission in favour of the Contest Sponsor; (v) agrees to release, indemnify, discharge and hold harmless the Sponsor and its directors, shareholders, officers and agents from any claim or liability arising from or related to the Submission; and (vi) consents to the publication and/or use, in any and all forms of media now known or hereafter devised including, without limitation, on the Internet, the entrant’s Submission for publicity purposes carried out by the Sponsor and/or its advertising and promotional agencies without payment or compensation of any kind. Contest Sponsor assumes no responsibility for any claims against infringement of the right of privacy with respect to any Submission.

  6. General

    By entering the Contest, entrants agree to abide by these Rules and further agree that the decisions of the Sponsor are final. The Sponsor reserves the right, subject to the approval of the Régie des Alcools, des courses et des jeux du Québec, at any time without prior notice to suspend, modify or terminate the Contest for any reason. The Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering or disrupting the online entry process operation of the Contest or acting in violation of these Rules. The Sponsor does not assume any responsibility for any lost, delayed, incorrect or incomplete entry information howsoever caused. In the event of a dispute, entries will be deemed to have been made by the authorized account holder of the Twitter, Instagram or Facebook account used to submit the Entry. "Authorized account holder" means the natural person to whom is assigned the social media account. You agree to the privacy policies and terms of use of Twitter (available at www.twitter.com), Instagram (available at www.instagram.com) and Facebook (available at www.facebook.com) and are solely responsible for ensuring that you comply with them at all times while participating in the Contest. This Contest is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter or Instagram. By participating in this Contest, you agree to a complete release of Facebook, Twitter and Instagram from any claims. In the event of any discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, as applicable, the English version shall prevail, govern and control.

  7. Privacy and Personal Information

    By entering the Contest each entrant consents to the collection, use and disclosure of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling the Contest. Any personal information will be handled in accordance with the privacy policy of the Sponsor which is located athttps://www.xplore.ca/policies/privacy-policy/. Any inquiry concerning the personal information held by the Sponsor should be addressed to the Sponsor at 625 Cochrane Drive, #1000, Markham, ON L3R 9R9.

  8. Publicity of Winner’s Name

    The name of the Prize winner may be posted online or otherwise beginning on the first business day after the winner has been contacted and has returned a fully completed contest eligibility and liability/publicity release to the Sponsor as set out above.

  9. Subject to Applicable Laws

    This Contest is governed by the laws of Canada, is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited. For Québec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des Alcools, des courses et des jeux du Québec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
